Kenji Yoshino’s article ” The New Civil Rights” is about how civil rights are not an independent achievement it is what everyone will benefit from. Yoshino also talks about how an individual has two selves, and they work together to better that person. The True self and the False self. Just like how people need to find something that everyone has in common to benefit them, the human ‘soul’ does the same. The True self is what gives the individual the feeling of being real and the False self is what gives the individual the feeling of being unreal in the sense that the world is still out there and it’s not just about you, it is there to build a relationship between the True self and the world. There is a balance between the two.

There also needs to be a balance between who gets what and when they get it. Yoshino makes the point that there is a balance within the courts almost. He makes the point that there are “liberty” claims and “equality” claims. Most court systems are more sympathetic towards liberty claims because they “emphasize what all Americans have in common” while equality claims “involve the Court in picking favorites among groups”. I believe that this is a good thing because there needs to be a balance and the system has tried to find that balance and it seems to work for the most part.
